India orders X to restrict obscene content on Grok

India orders X to restrict obscene content on Grok

On Friday, India’s IT ministry—the government department responsible for information technology regulation—ordered X to make immediate technical and procedural changes to Grok, the AI chatbot developed by xAI, regarding content generation. The regulatory order directs the platform, owned by Elon Musk, to restrict the generation of content involving “nudity, sexualization, sexually explicit, or otherwise unlawful” material. The Indian government has given X exactly 72 hours to submit an action-taken report detailing the specific steps it has implemented to prevent the hosting or dissemination of content deemed “obscene, pornographic, vulgar, indecent, sexually explicit, pedophilic, or otherwise prohibited under law.” The directive follows a formal complaint filed by Indian parliamentarian Priyanka Chaturvedi.

The order warns that failure to comply could jeopardize X’s safe harbor protections, which provide legal immunity from liability for user-generated content under Indian law. According to the Indian government, noncompliance could lead to legal action against X under India’s IT law and criminal statutes. The warning applies to the platform, its responsible officers, and its users. In its official communication, the Indian government stated: “It is reiterated that non-compliance with the above requirements shall be viewed seriously and may result in strict legal consequences against your platform, its responsible officers and the users on the platform who violate the law, without any further notice.”

This specific directive follows a broader advisory issued by the Indian IT ministry on Monday. That advisory reminded social media platforms that compliance with local laws governing obscene and sexually explicit content is a prerequisite for retaining safe harbor protections. The ministry’s actions highlight a tightening regulatory environment for AI developers and social media platforms operating within the country, as governments seek to establish clear boundaries for AI-generated outputs.

This regulatory move positions India as a critical test case for how governments hold platforms responsible for AI-generated content. As one of the world’s largest digital markets, India’s enforcement decisions carry significant weight. Any tightening of regulations in the country could have major ripple effects for global technology companies operating across multiple jurisdictions, particularly as they deploy generative AI tools.
